I may have mentioned this before, but anyway i missed a payment in December (i pay by cheque as direct debits piss me off) as i wanted a little extra money for christmas. Just before the 25th i receive a reminder, just into the new year i receive a summons. Which i ignored seeing as how i paid the bill in full as soon as the new year started. They want costs however.

Now a new summons appears, i`ve decided to fight the feckers so i`m in court on 1st March. With the summons they sent me a statement of means, unbelievably patronising. I`ve paid the bill, as i do every year and these white caller wankers want me to tell them how much fucking money i spend a week on clothes.

I`ll have to take some sort of medication to keep me calm as i can see myself going apeshit if the magistrate sides with the council. I should probably just plead guilty and pay `em, but i don`t like being rolled over like that.
 
I can't see the council taking you to court unless they are 100% certain to win, after which you could end up with more costs. I'd try and arrange a meeting with someone face to face and put together a sob story rather than going the legal route.
 
I agree with Euro in that too many of them are complete beaurocratic clowns. My ex moved out at the beginning of Nov and I filled in the necessary paperwork and sent off to claim the single occupants discount. I got a letter rejecting it saying I had to "prove" she had moved out by giving a forwarding address. I contacted them and told them I didn't have one, and how was that down to me to prove. If somebody ups and leaves, how is the onus on another person? Anyway, have sent solicitor's letter with payment details of payoff as proof. Can still imagine them trying to say not enough proofat which point I would do the same as Euro and withhold payment.
 
This will all depend on if you recieved the court summons you ignored before you payed the bill, if you did you will lose and the court costs should be payed.

Because they want you to.

My reason for asking was that in Glasgow City Council the date is the 28th of the month. If that is also the case with yours, then they have sent out a reminder (and thus started the chain) prior to the date within which you are entitled to pay your bill. It could therefore be argued that by not giving you the agreed amount of time to pay your bill before commencing their debt collection activities that they have incurred the legal costs for which they now seek compensation, entirely outwith your actions (whether or not you were late in paying your bill).

I have no idea if that would actually work, mind you, but it sounds good.
 
Most bills require you to pay by a certain date, by choosing to not pay as you needed xmas money you are in the wrong.

However it does seem to me to be a bit of using a sledgehammer to crack a nut.

On a small tangent could you explain why direct debits annoy you? You can specify the date you pay all your bills. I have been paying bills like this for 6 years and am yet to receive a summons, maybe you should re-think your approach.

Also I would ask that you try to tone down the language you use on threads

Euro I feel sorry for you. I thought your first post displayed the frustration and anger you feel towards the council. Then you have people telling you to mind your language. Are you sure its your responsibility to pay and not your Dad's.
 
Was the bill council rates, or something associated with council rates? Surely having a direct debit set up with all your known creditors is far more beneficial and easier for you to keep track of? This is how I pay my bills, along with B-Pay. I can print out a monthly report of debits and credits against my account. Easy way to keep track of movement.

Unfortunately life is not fair for anyone Euro. Someone once told me there were two guarantees in life, death and taxes.

Why don't you just pay the bill, and get on with it? It saves you the stress of having to show up to court, with the possibility of footing more money out. Is it really worth paying someone else's legal fees in court?

That`s the whole point, i have paid my Council Tax bill in full, as i have done every year since i`ve lived here.

Last year i paid the last two installments together, that was the plan this year. Unfortunately Chorley Borough Council couldn`t ^%^%&*^ wait.

The year before that they tried taking me to court because they didn`t rceive the final payment. i sent it, but it went to the wrong department, probably because of the retards they have in the post opening section. All this will be brought up in court.

You never answered me Euro, did the court summons arrive on your doorstep before you payed the bill ?
 
No, first i had a reminder just before Xmas, i sent the final payments in the new year - then i received a summons. Ignored it, then they tried *&%&*^*& me on the costs.
 
Ignoring it was the mistake .

Was your cheque cashed before the summons was issued?
 
I doubt it, the summons arrived around three days later if memory serves. I just figured as i`d paid the bill i was not liable for any extra charges.

I mean, i`m a single bloke with no kids, i`m hardly getting value for money as it is.
