Fixed Term Contract Rights?

I have just been made redundant and i need advice as to what i can get the company to pay me. I want all my holiday pay and to be paid to the end of 6 months contract, ending in April.

Have I any rights where this is concerned? Would much appreciate some advice.

It sounds as if you were on a short term contract. You are entitled to be paid to the end of your contract. You'll need to check the details of the contract to discover to what holiday pay you were entitled.
 
Have no idea, but i know i would of had to give them a month. They gave me a minute. Also found another girl in the office has been made redundant today, she doesn't have to leave till the 24th and has 4wks paid holiday. Bit inconsistant.
 
I think there has been a change in the regulations recently, that prevents employers from treating Fixed Term Employees differently from those with permanent contracts even if their period of employment is less than two years, providing they were employed after a certain date.

Employment law isn't my forté I am afraid, but I am sure that I read something recently to that effect. Perhaps someone more knowledgable can shed some light on it further?
 
That is true, Betsmate but the problem is that if you have less than a year's service with a company your rights are pretty limited anyway!!

It really all depends upon the contract - if there is a notice clause in it, the entitlement to pay will not exceed the length of the notice period. Similarly, holiday pay will probably be paid pro rata for the period of employment.
 
Aha - it may well do ...

But, unfortunately, you're still unlikely to get paid out until April and you probably won't get all the holiday pay. Have you not got a copy of your contract somewhere? Have they not given you any indication of what you will be paid?
 
They said i'd get paid till the end of the day. On the day i was in to much shock to contest. Yes i have somewhere, its also on their online system,which i obviously don't have access to now.
 
As Muttley says, the best way to know what you are due is to read your contract - you must surely have a copy of it kept in a safe place? It will say in there how much notice they can give you (in the same place as it says how much notice you give them). Any queries with your contract & ACAS will be able to advice you further.
 
Your best move is to be in a union that can advise you . Absent that find out if there is a Law Centre near you.

If you have been employed more than a year you might have been unfairly dismissed by way of redundancy . The employer is usually required to consult, apply fair selection criteria and consider suitable alternative employment if possible before making anyone redundant.

Don't want to put a damper on things but there is a possibility that they were quite within their rights to do what they did.
