You do have to wonder why the horses passport couldn't have been stamped by the vet responsible and the BHA notified though? Surely this would have prevented him from running the horse. Its a legal operation but not for a racehorse that is intending to continue its racing career.
 
Welfare comes first, I think he deserved the ban. I think Howard should have got more personally.

It's a operation of last resort anyway and to race a horse like that is so dangerous. He is obviously someone who is economical with the truth as well. It shouldn't be hard for the vets to be advised to put this in passports, but if they are not told its a racehorse how are they to know? But I don't think this op should be done for anything other than ensuring paddock soundness, it's a sticky plaster and does nothing to treat the actual problem.

I'm pretty sure there's no requirement for the vets to declare to the BHB that they have done the operation, and as things stand at the moment it would be a breach of client confidentiality if they did. Onus is completely on the keeper of the horse (so trainer rather than owner) to be honest about what's gone on.

Nurectomies are illegal for all horses competing under FEI rules as well so you shouldn't find any of the eventers/show jumpers etc have had it done, but I bet if someone was to check them all there would be a few that mysteriously retire....
