Can i ask for abit of advise please ?

Here's the situation my daughter is looking to become pregnant and apparently her employer has said if she does get pregnant she will have to leave the job when the time comes with no maternity pay. She has been working in this job about 2yrs and albeit its only a hot and cold meats shop she is the only original staff left from when she began.
So where does she stand, does her employer have to pay maternity by law or is it a matter of if they want to ?.

Now im not up to speed regarding maternity and such so any help is appreiated.

Completely unlawful and absolutely scandalous. :angy:

First , yes he is obliged to pay maternity pay

Second, to dismiss someone on grounds of pregnancy is automatically unfair dismissal no matter how long you have worked there

Third, it would be actionable sex discrimination with damages potentially running into several thousand .

The best thing The Pro is go to the website of the Equal Opportunities Commission which tells you about rights to equal treatment on grounds of sex and should help - it has specific sections on knowing your rights and the law.

Yes i thought as much, regarding it being unlawful, there was a girl employed there who was in the same boat who was actually pregnant and he told the same to her "Id rather you just left", and as most of his staff are mainly young girls upto the age of say 22 they just leave not knowing as did this particular one. So knowing this i can tell my daugther and when she does become pregnant she can know where she stands.

Um, am I missing something here The Pro?? You say you're 29 years old!!!!! Blimey you must have started early if your daughter is working & thinking of having a baby already!!!!

Step daughter, she's 20 in may, although i treat her as my own and in no way different to mine own blood so i don't really like saying step, as ive looked after her since she was 9yrs. My wife is a cradle snatcher. :P

Thanks Muttley, im going to print some of these out, and then when her employer does say these things she has them at hand.
 
Does the 2 yr in employment rule affect maternity payments, it once affected your rights to a tribunal through being dismissed as one had to be working for the same company for the 2 yr duration??????or as that also changed...............just a tentative inquiry.... :suspect:
 
Ive just this minute read this if thats what you mean Merlin.

* Employed by your employer into the qualifying week which is the 15th week before the week your baby is due.
* Employed by the same employer without a break for at least 26 weeks into the 15th week before the week your baby is due. Part weeks count as full weeks.
* Earning before tax an average of £84.00 a week. This is called the Lower Earnings Limit for National Insurance Contributions (NI) and is the amount you have to earn to qualify for benefits. You have to earn more than this amount before you actually start paying NI.

If YES to all, claim SMP.
 
If I'd had any sense I'd have got up the duff in Gib - they love babies & things and there are all sorts of tasty tax codes & things for having a sprog.

Nah - scratch that, I did have good sense which is why I'm not up the duff!! :laughing:
 
DOM if only...I new about your dillema I would have had my vasectomy reversed......WOW!!!. :P :laughing: :laughing: :laughing:

The Pro its pretty similar to that but obviously the employment laws have changed over the years.........

One year now for unfair dismissal

Dismissal for being pregnant would also be sex discrimination and there is no qualifying period for that.
 
Tell her don't do it! I had my daughter when i was 18, she wasnt planned and although she is the best thing in my life i wish to god that i had waited as there is so many things I wish i could have done before being tied down. Leave it 5 more years and if she still wants a baby she only be 25 it and maybe will have saved up a bit more money, had a life etc beforehand. But its up to her, i love my Zo to bits but i wouldn't do it again if i had the chance.
 
To say we're not best pleased she wants a baby so young is an understatement (though im a hypocrite as i had Kayleigh when i was 19), and ive told her that she's not really lived yet and there's plenty of time for kids (although it was different for me a young army lad id lived 10 times over by 19 in regards having fun), but thats all i can say without sounding like im interfering. But i do know her and her boyfriend are sensible, both have jobs with money saved, have a nice flat and im sure whatever desicion they make will be the right one for them and i have to respect that as does my wife and as the saying goes it doesn't matter what you tell some people, they always have to find out the hard way for themselfs.
