I've just had call from work to say we are all being made redundant in three weeks :( its only a part time job but the money is needed, I've told them I'm leaving straight away & they said if I did they wouldn't pay me my holiday pay

It would be silly to cut off your nose to spite your face, though they can't withhold contractual holiday pay (unless you have broken the contract).

I'm thinking of going to see the local CAB but not sure if they are any good, my employers have known about this for several weeks but have only just decided to tell us, I have three weeks holiday pay to come & said that I wanted to leave now but they told me they would not pay me it if I left

I'm fairly certain that an employer can only request a specific period of "notice" time. They are not entitled to demand it, regardless of whether it is mentioned in your contract or not (it is there as a request).

I assume that you are not entitled to any redundancy payment Aldaniti (which would probably be lost by leaving before the specified date)?

Not sure if it changes for part-time workers (no doubt someone else will know), but I believe that you are entitled to 1 week's wages per year of employment. I wouldn't be sure if this gets pro-rated or not.

Two years would be a significant landmark if I'm not mistaken. Something to do with permanency I think. That may have something to do with the redundancy. Where's Ardross when we need him? LordH?

(1) Redundancy entitlement applies to part-time workers.

(2) But only, as with full-time workers, after two yearsd continuous employment.

(3) Notice periods are normaly contractual.
