Licence To Murder

What about shooting a person in the front without knowing they are armed are not?

I don't have a gun, but if one magically appeared, my family's safety would be the first and only consideration. I tend to think I would wait to examine the corpse to establish whether or not it was armed.

I don't believe that such an action is reasonable, although in Tony Martin's case there were extenuating circumstances which may have made it more reasonable than such a dispassionate view would take.

I have often had the following thought. If someone breaks into my house, and lets say I have a golf club to hand which, following a confrontation with the burglar I am forced to use to defend myself. Say someone else calls the police whilst I try to ensure that the burglar does not escape apprehension by maintainging a watching brief.

The burglar then has another go at me and receives a swift wood to the ear for his trouble. Suppose that he eventually dies, after the police have taken an hour to arrive. I have never used more than one stroke at a time, but I have still killed said person.

Should I be convicted or murder, manslaughter or should some other verdict be reached?
