No, I don't think it would be ok in a Kempton seller either, the point was supposed to be that there was quite a lot more to take into account than simply being awarded a race, especially when it comes to the broodmare status.
I agree that plenty of horses don't get thrown out when it seems that they should and that the consistency isn't there. I do believe though that the crux of this result was that the winning distance was less than a short head. There are believed to have been guidelines issued a year or so ago that said that were a winning distance to be a short head or less (a nose I believe it was in the Guineas) and there was a case of interference proven or there was reasonable doubt over the case, that the offending creature should be thrown out.
