Point Blank: What Was Philip Byrnes’ Last Thought
I don’t need analysis from Ted Walsh, Leighton Aspell or Davy Russell.
I don't even see where the 'risk of injury' they all spoke about was coming from, Slimmers. It was soft bunny hop, without any hazrad coming from behind him. As somebody on here might put it, 'there'd be a greater risk of injury rolling off me mott's sister.'
I get that. I just thought it cringey all his inside supporters telling the ignorant public that the risk of certain death would dissuade anybody from leaping off a moving horse. The dive was so managed that the most he risked was a mild bruise to his left buttock.
There's more chance of Man Utd winning the treble than anyone losing their license over this I'm afraid. If will be a disgrace if they don't take the licence off him. They set a dangerous precedent letting Hogan off over the Dundalk clsimer.
I agree. Anyone is allowed to express an opinion as to what the footage shows. As no-one can know what he was thinking when he departed from the horse, it can only ever be an opinion, and everyone reading knows it's an opinion and can see the footage for themselves. If your opinion is that it's obvious he jumped, to say so is not defamatory. There is nothing libelous in what I said. I'm giving an opinion on freely available footage of this race.
That's not been my understanding of how the Law works these past 40 years, tbh.If your opinion is that it's obvious he jumped, to say so is not defamatory.

But I've had my say earlier in the thread and to add to it would merely be to repeat myself.
I have private opinions on all manner of things I couldn't actually prove in a court of law - that's why those opinions stay private.
For sure (think I alluded to it earlier in the thread) - there will be literally hundreds who've publicly expressed the same opinion and there can be safety in numbers. They'll be a long time litigating all the people that hold the same opinion as me.

But the higher the profile, the bigger the audience and those are the people who get targeted for litigation if such high-profile people express an opinion which is potentially defamatory and libellous if unable to be proven to be true.
When you eventually rise to dominate all racing and betting media (as you inevitably will if you cba to) and if we are still on speaking terms at that juncture, your phone will be forever going off like an Uzi with messages from me saying: "You're read and watched/listened to by MILLIONS, you can't say THAT, you'd never be able to prove it and you'll end up in the fecking DOCK."Funny you mention that. Jane Mangan was clearly not happy seeing me in Thurles today!

And it's 1.01 that, if you reply at all, it will be: "If I ever want your opinion, I'll ask for it - now feck off."
Shame we can't get a bet on it, really.
